The present terms and conditions regulate the acquisition of products offered on the website www.sklum.com, the owner being INDECEMI, S.L. (From here on out, SKLUM).
The acquisition of any of these products leads to the complete acceptance of each and every one of the present Conditions, with no repercussions on the acceptance of any particular Conditions which could be applied on certain products.
These Terms and Conditions may be modified without any prior notice; therefore it is recommended that you carefully read these contents before proceeding to acquire any of the offered products.

3. Products
The products offered, along with their main characteristics and price, are displayed on screen.
SKLUM reserves the right to decide, at any time, the products and/or services offered to the Customer. Likewise, SKLUM may, at any time, add new products and/or services to those currently offered. In this way, SKLUM also reserves the right to withdraw or stop offering, at any time, and without prior notice, any of the products offered.
All of this without limiting the fact that the acquisition of any of the products can only be done through the subscription or registration of the USER, with SKLUM giving the interested party a user name and a password, which will identify and enable him/her personally to have access to the products.
Once inside www.sklum.com, and to access the acquisition of the different products, the User will have to follow all the instructions indicated in the purchase process, which will suppose the reading and acceptance of all the general and particular conditions fixed in www.sklum.com.
OBSERVATIONS
The offers presented by SKLUM are valid within the limit of available stock. SKLUM reserves the right to modify the range of its products according to the conditions imposed by its suppliers.
The purchased product may be subject to, due to the availability of the manufacturer, non-substantial modifications in the components, characteristics or performance of the lot of which it came from, provided that they do not imply a decrease in the qualities and performance advertised. Furthermore, this information may contain inaccuracies or typographical errors, which may be changed, corrected or deleted at any time. SKLUM may make changes or modifications to the products at any time. THE IMAGES PUBLISHED ARE MERELY ILLUSTRATIVE.
WARNING
The consumer must, in any case, and before making the purchase of an article from those offered, ensure that it is suitable for the use the consumer wants to give it.
The customer is responsible for following and respecting the indications and safety recommendations mentioned below.
At SKLUM we recommend fixing and/or securing the furniture to avoid possible damage due to the fact that serious or fatal injuries can occur if a piece of furniture were to tip over. To prevent it from falling over, it must be permanently fixed to the wall with the necessary fixing devices and fittings, depending on the type of wall.
Certain precautions must be taken even after assembly:
- Do not place a television or any other heavy object on top of a chest of drawers or other furniture which has not been designed for that purpose.
- Place heavy objects in the drawers below.
- Do not let children climb or hang themselves from drawers, doors or shelves.
- Check the stability of the furniture.
- Do not allow children to climb on the furniture and open more than one drawer at a time.
- Install devices that fix the furniture to the wall. Do the same with the appliances you put on top of it.
SKLUM is not responsible for any injury, damage or harm caused by not following the above recommendations.
With regard to hammocks, sun loungers and similar articles, to ensure their stability, we at SKLUM recommend that you tighten the screws at least once a year.
Before each use make sure that the assembly is adequate, that the screws are properly tightened and that the article is in perfect condition for optimal use and thus avoid possible injuries from falling or trapped fingers.
4. Availability and Substitutions
PRODUCTS
SKLUM aims to guarantee the availability of all products that are advertised through www.sklum.com. However, in the event that any product ordered is not available or if it is out of stock, the customer will be informed within 24/48 hours of placing the order. In the event that the product is not in stock when the order is placed, the customer will be able to RESERVE the product, so that it can be provided as soon as possible.
If the product is not available, and the consumer has been informed of this, SKLUM may supply a product of similar characteristics without increasing the price, in which case the consumer may accept or reject it by exercising their right to renouncement and the termination of the contract.
In the event of unavailability of all or part of the order, and the rejection of the replacement products by the customer, the refund will be made within 15 calendar days.
5. Purchase and/or Acquisition Process
To make any purchase at www.sklum.com, the customer must be of legal age.
It will also be necessary for the client to register at www.sklum.com by submitting a data collection form in which SKLUM will be provided with the necessary information for the contract; data that will be true, exact and complete about the client's identity and that the client must expressly consent to by accepting SKLUM's privacy policy.
It is also recommended that the customer prints and/or saves a copy of the sales conditions when placing the order, as well as the order confirmation sent by SKLUM via e-mail.
To cancel an order, you must request this cancellation by accessing your customer area*, in order to give it the highest priority and thus be able to cancel the delivery of the order. This is the only way to block the shipment.

BILLING
The customer agrees to receive the invoice in electronic format. The customer will receive the invoice in the MY ORDERS section of his user account.
6. Delivery

The order will be delivered to the address designated by the customer at the time of contracting according to the method chosen.

METHODS AND DEADLINES
1. Orders will be delivered to the person and address indicated in the order:
Orders will be delivered to the customer through REDUR (DHL), (SEUR) DPD courier or parcel service companies or other companies that deliver on pallets such as DACHSER. The order will be considered delivered when the carrier has delivered the package to the customer, and the customer signs the delivery receipt document. It is the customer's responsibility to verify the state of the goods on reception and to indicate any anomalies on the delivery receipt (if this is not the case, no claim for transport breakage will be accepted).
AT THE TIME OF DELIVERY:
As soon as the consumer takes possession of the goods, the risk of loss or damage is transferred to him/her. It is therefore important:
- Do not sign the delivery note until you have checked the contents of the packages and the condition of the goods
- Don't give in to pressure from the delivery company, take the time to examine your goods.
If, on inspection of the goods, it is found that they do not comply with the order or that they have been damaged during transport, they must be rejected and, above all, you must indicate your explicit concerns on the delivery note (a compulsory condition for making any claim for breakage or damage during transport)
The maximum delivery time is 5-7 business days from dispatch (as long as all the products in the order are in stock) except for palletised orders (large orders), where delivery can be made in 7-10 business days.
In the event of total or partial unavailability of the order, it will be automatically blocked and shipped as soon as ALL the products in the order are available.
Orders will be dispatched to the customer within 48/72 hours (working hours) from confirmation of the purchase or order, provided that the customer has placed the order before 4 p.m. No orders will be sent or delivered at weekends or on public holidays.
IMPORTANT: The standard door to door service does not include the delivery to premises that are beyond the ground floor, this must be paid for by the customer. The assembly is not included either.
7. Prices, Expenses and Taxes
The prices of the products shown on www.sklum.com will be expressed in Pounds unless otherwise stated and are guaranteed during a certain time, except for misprints, no matter what the destination of the order is.
PRODUCTS
The final prices of all the products (and, if necessary, the final prices per unit of measurement, where this is required) together with their characteristics, offers, discounts, etc., are reflected in each of the articles that appear on the www.sklum.com catalogue.
- The products have VAT included.
- The VAT rate is 20%, except for those companies registered in the Register of Intercommunity Operations.
- Shipping costs: The customer will pay the shipping costs, in the case of particular clients.
- Other additional costs: Return costs: Depending on the type of return, the collection costs will be paid by the customer. If the cancellation of the order is communicated before the order is sent, the customer will be exempt from any costs.
Product prices may vary at any time. In this case, the price to be applied will be that in effect on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before the customer formalises its acceptance.
8. Payment Methods
The following payment methods are available to you:
a. By credit or debit card
You can make the payment immediately through our bank's SSL secure payment platform. In case of return or cancellation of the order, the amount will be refunded through the same payment method the order was made with. Both personal and banking data will be protected with all the security measures established by the Organic Law on Data Protection 15/1999 and its Development Regulations with total confidentiality.
SKLUM accepts payments with VISA, Verified by VISA, MasterCard and MasterCard SecureCode. When placing the order, the customer will provide his/her card details, which will be stored directly in Gateway 4B during the purchase process. SKLUM does not store information regarding credit cards. For internal reasons of the Organization, the charges are carried out through Santander Bank, without this having any consequences for the customer's privacy.
b. By Bank Transfer
By cash deposit or bank transfer in favour of INDECEMI, SL. to the account number indicated in the order confirmation e-mail. The customer's name and order number must be indicated when making the transfer.
Orders that are not paid within 7 days of the order confirmation will be automatically cancelled.
c. PayPal
Through PayPal the payment of the order will be authorised, but no money will be withdrawn until PayPal verifies that it is correct. For this, it will be essential to have a PayPal account.

9. Return and Withdrawal Policy
As established by the regulations, the consumer and user will have the right to TERMINATE the contract and return for a maximum period of 14 calendar days* without the need to indicate the reason and without incurring any cost, except for those provided for in articles 107.2 and 108 of RD1/2007, of 16 November, which approves the above-mentioned text of the General Law for the Defence of Consumers and Users.
PRODUCTS
The customer will have a maximum period of 14 calendar days from the day of receipt of the goods or product ordered to inform SKLUM of their wish to withdraw from the contract.
The withdrawal implies that SKLUM will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure used by the customer for its payment.
During this period, the consumer will inform the supplier of their decision to withdraw from the contract by filling in the form at the end of this page and sending it to SKLUM's e-mail address.
SKLUM will inform the consumer of acknowledgement of receipt of said renouncement. In order to return a product, it is essential that it is in perfect condition and in its original packaging, with all its accessories and without having been used and/or assembled.
Once we receive this request we will contact the customer to indicate the details of the return. The customer will bear the cost of returning the goods.
OBSERVATIONS
No product manipulated by the client in bad use, breakage, etc. will be changed or paid for; otherwise, all warranty will be lost. In case of a defective product, the return costs will be charged to SKLUM. In other cases, these will be assumed by the customer. If the cancellation of the order is communicated before the shipment of the order, the customer will be exempt from any expenses. In case of replacement of a product, it may not necessarily be the same as the previous one, but in any case an improved version or model, since the products are subject to continuous improvement. If the product is in good condition, but the packaging (box, plastic or wrapping) in which the product is found is not in good condition, the return will not be admitted; the same will happen if the product is not in good condition. Both the collection of the product and its return will be managed by SKLUM through our courier service.

10. Warranty
Products purchased through www.sklum.com enjoy a 2-year warranty period from the time of delivery, which covers possible manufacturing defects of the product, as well as any breakdowns produced during that period.
The user must inform SKLUM of the lack of conformity within two months of becoming aware of it.
The buyer has a 2 year warranty, which will come into force taking into account the date of purchase detailed on the sales invoice. On request, an extension of the guarantee could be considered or a customised project guarantee offered, after evaluating the conditions of application. SKLUM is not responsible for damage caused by non-professional installation, products modified or manipulated by the client or any other person not authorised by the manufacturer; as well as for improper use, modification and/or apparent signs of incorrect treatment.The product to be repaired or replaced must always correspond to the one sent by SKLUM, enclosing the delivery note and/or invoice. In case of repair of a product, the customer can manage this repair directly, arranging it and sending it. To do so, the client must contact SKLUM and request the necessary instructions, as well as RMA authorisation. It is important that the returns to our technical support are perfectly packed and protected, without stickers or labels on the original packaging and protections. If the product arrives at SKLUM's facilities with damage attributable to deficient packaging or protection, the repair may not be covered by the warranty. If the original packaging is not available, the customer must use a resistant box of sufficient size to allow the equipment to be inserted with ease; it is recommended that the customer introduce protective material in sufficient quantity (bubble wrap or paper or foam, etc.) under, over and around the product, in order to prevent any movement of the product inside the packaging. The customer must indicate on the shipping label the RMA number provided by SKLUM.
Excluded from the warranty are consumable products, deficiencies caused by improper use or handling, incorrect installation or defects resulting from any external cause.
For products of a durable nature, the consumer shall be entitled to adequate technical service and spare parts for a minimum of 5 years from the date on which the product ceases to be manufactured, and the price of spare parts may not be increased when they are applied to repairs.

To avoid problems with the installation or handling of the purchased product, make sure you have followed the installation and operating instructions contained in the user manuals.
Usually our technical services will require the following information:
- Invoice number.
- Identification of the specific model.
- Serial number.
OBSERVATIONS
The warranty does not cover damage caused by external factors such as atmospheric phenomena, fire, water, abnormal use of the product, accidental falls or incorrect use by individuals or companies not authorised by SKLUM. Likewise, it does not cover wear and tear for hours, improper use or negligence before or during use, as well as breakage caused by incorrect installation or handling and storage. Claims for natural loss of shine/Colour or degradation of the same are exempt from warranty coverage. SKLUM reserves the right to study each returned product by independent specialists, the warranty being exempted if it is proven, by the competent authorities, that the breakage has been caused by the client, as well as the partial breakage of the product to force the use of the warranty for the return or refund of the product; in these cases, the expenses of the expert opinion will be assumed by the client. SKLUM is not obliged to compensate the customer or third parties for the consequences of the use of the product, be it direct or indirect damage, accidents suffered by individuals, damage to property other than the product, loss of profit or loss of income.

11. Liability and Disclaimer conditions
The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract terminated, as established in Law 26/1984 Of 19 July of the General Law for the Defence of Consumers and Users.
If the product does not comply with the contract, the consumer may choose between the repair or replacement of the product, both of which are free for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.
If, after the repair has been completed and the product delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a reduction in price or the cancellation of the contract.
SKLUM may suspend, withdraw or cancel partially or totally the products not subject to the contract at any time and without prior notice. The above stipulation shall not affect those products that are reserved for registered users or that are subject to prior purchase and which shall be subject to their specific conditions.

13. Applicable law
The parties submit, at their request, to resolve conflicts and renounce any other jurisdiction, including the courts of the customer’s home. The language used will be Spanish.
